The binding terms governing your ticket purchases, festival pass reservations, auditorium admissions, and use of TheatreKE.

Welcome to TheatreKE. These Terms & Conditions (“Terms”) establish the contractual relationship governing your access to and usage of the TheatreKE platform, website, and related ticket processing services (collectively, the “Platform”).

By accessing TheatreKE or securing tickets, you confirm that you have read, understood, and agreed to be bound by these Terms.

Section 01

About TheatreKE

TheatreKE is a digital platform that enables users to discover, promote, manage, and purchase tickets for theatre productions, cultural events, film screenings, festivals, workshops, and other live performing arts experiences.

TheatreKE acts as a technology intermediary connecting event organizers, venues, performing artists, and patrons. Unless expressly stated otherwise in writing, TheatreKE is not the primary producer, promoter, or operator of the individual events listed on the Platform.

Section 02

Eligibility

To use the Platform, you represent and warrant that you:

  • Are at least 18 years old, or
  • Possess valid legal consent from a parent or legal guardian if under 18 years of age.
  • Provide authentic, accurate, and current information when registering an account.

TheatreKE reserves the right to suspend or terminate any account found to contain fraudulent, misleading, or impersonated details.

Section 03

User Accounts & Security

When creating an account on TheatreKE, you agree to:

  • Safeguard your password and multi-factor authentication credentials.
  • Keep your billing, telephone, and email coordinates up to date.
  • Notify TheatreKE immediately upon detecting any suspected unauthorized access.
  • Accept responsibility for all actions and transactions processed through your authenticated session.
Section 04

Ticket Purchases & Passes

When purchasing single tickets, flex bundles, or festival passes:

  • All applicable face prices, platform convenience fees, and VAT are disclosed prior to final checkout.
  • Bookings are confirmed strictly upon clearance by our payment gateway providers (e.g., M-Pesa STK push, card tokenization).
  • Encrypted digital tickets bearing unique single-use QR codes are dispatched electronically via email and stored in your account dashboard.
  • Season, Week, and Day Passes grant access strictly to their designated schedules and cannot be split across multiple attendees.
Section 05

Event Listings & Schedules

Event schedules, age advisories, synopsis details, cast credits, seating layouts, and venue specifications are provided directly by production organizers and theatre companies.

While TheatreKE exercises quality oversight, we cannot guarantee that production notes or start times remain completely immutable. Producers reserve the right to alter cast lineups or technical runtimes when operational contingencies arise.

Section 06

Refunds, Cancellations & Postponements

Refund parameters are primarily dictated by the specific producer or festival governing body:

Event Cancellation

If an event is cancelled with no rescheduled date, patrons are entitled to a full refund to their original payment channel (less statutory telecommunication carrier fees where applicable).

Event Postponement

Tickets remain valid for the newly announced date automatically. Ticket holders unable to attend the revised date can request a refund within 14 days of the announcement.

Patron Non-Attendance

Failure to attend a confirmed performance due to personal delays or missed curfews does not warrant a refund or seat credit.

Section 07

Ticket Resale & Touting Prevention

To preserve equitable access and prevent secondary scalping:

  • Tickets may not be resold above face value or bundled into unauthorized commercial packages.
  • Duplicated, altered, or bootlegged QR passes will be rejected at auditorium doors without compensation.
  • Official digital ticket re-assignment must be completed through TheatreKE's account portal.
Section 08

Venue Protocol & Admission

Ticket holders must abide by venue policies, safety measures, and security instructions:

  • Bag inspections and metal detection sweeps at venue gates.
  • Strict bans on unauthorized flash photography, professional audio gear, and commercial videography during live stage acts.
  • Observance of latecomer entry holds — late arrivals may only be seated during designated scene breaks.

Auditorium management reserves the right to deny admission or remove patrons who engage in disruptive, abusive, or unsafe behavior without refund.

Section 09

Organizer Obligations

Event creators, promoters, and theatre groups utilizing TheatreKE agree to:

  • Hold all required staging clearances, rights, royalty licenses (e.g., MCSK, PRISK, KECOBO), and permits.
  • Deliver the artistic performance as scheduled and advertised to the public.
  • Accurately declare venue seating charts and safety capacities.
  • Remit all mandatory taxes and cooperate on ticketing settlement reconciliation.
Section 10

Prohibited Platform Activities

Users and API integrators are strictly barred from:

  • Deploying automated scrapers, ticketing bots, or high-frequency query scripts.
  • Reverse-engineering the Platform codebase, database, or digital ticketing infrastructure.
  • Circumventing purchase quantity caps or pass allocation limits.
  • Transmitting malicious files, SQL exploits, or DDoS payloads.
Violation of these safeguards will trigger immediate blacklisting and referral to law enforcement.
Section 11

Intellectual Property Rights

All proprietary components of TheatreKE — including application software, UI layouts, styling, algorithms, trademarks, and logos — are owned by TheatreKE or its licensors and are protected under Kenyan and international copyright treaties.

Playwright scripts, poster graphics, show trailers, and production branding remain the intellectual property of their respective creators and production companies.

Section 12

Data Protection & Privacy

We respect your personal data and adhere strictly to the Kenya Data Protection Act (2019). We collect customer phone numbers and email addresses exclusively to fulfill ticket dispatches, process transactions, and provide critical show updates.

We do not sell, rent, or trade customer contact records to third-party advertisers. Please refer to our dedicated Privacy Policy for full disclosure on data retention schedules.

Section 13

Platform Availability & Uptime

While TheatreKE maintains modern redundant cloud architecture with 99.9% targeted uptime, we cannot guarantee uninterrupted access during scheduled maintenance windows, telco network disruptions, or external infrastructure outages.

Section 14

Limitation of Liability

To the maximum extent permitted by applicable law, TheatreKE is not liable for:

  • Artistic performance modifications, cast substitutions, or show cancellations.
  • Physical damages, theft, or personal injuries sustained on venue premises.
  • Indirect, exemplary, incidental, or consequential business losses.

In all events, TheatreKE's aggregate liability arising out of any ticket transaction shall not exceed the gross amount paid by the purchaser for that ticket.

Section 15

Indemnification

You agree to defend, indemnify, and hold harmless TheatreKE, its directors, developers, employees, and agents from any claims, liabilities, damages, or expenses arising from your misuse of the platform, violation of these Terms, or breach of any third-party rights.

Section 16

Account Suspension & Termination

TheatreKE reserves the right to suspend accounts, revoke passes, cancel pending orders, or ban users who breach platform integrity, commit fraudulent chargebacks, or disrupt live theatrical events.

Section 17

Modifications to Terms

We periodically update these Terms to reflect legislative changes, platform upgrades, or revised ticketing policies. Updated versions will be published with a revised “Last Updated” timestamp. Continued engagement with our services constitutes agreement to the updated framework.

Section 18

Governing Law & Jurisdiction

These Terms and any non-contractual disputes arising from them are governed by and construed in accordance with the laws of the Republic of Kenya. Both parties consent to the exclusive jurisdiction of the competent courts sitting in Nairobi, Kenya.
